EPA RESISTS CALLS TO CLARIFY WASTE RULES' APPLICABILITY TO E-85 ETHANOL

EPA is resisting calls from state waste regulators and some industry officials to clarify its Resource Conservation & Recovery Act (RCRA) rules to ensure that high-grade ethanol fuel is a regulated substance under the waste law, subject to strict underground storage tank and other requirements and eligible for federal cleanup funds. The issue has become a high-profile concern among state waste officials who are confused over whether fuel with an 85-percent ethanol content (E85) is a regulated "petroleum product" or "motor fuel" subject to RCRA's underground storage tank (UST) rules and eligible for federal UST cleanup funds.
