EPA's recent surprise announcement that it is killing two controversial proposals critics say would weaken the Clean Air Act new source review (NSR) program came after the agency's enforcement and regional officials issued virtually unprecedented "nonconcurrence" memos opposing the rules, an informed source says. White House Office of Information & Regulatory Affairs (OIRA) chief Susan Dudley announced Dec. 10 that EPA would not finalize a pending rule to relax the emissions test for when power plants trigger NSR's pollution control requirements, nor would the agency finalize an equally contentious NSR rule that would have eased construction of industrial facilities near national parks (Inside EPA, Dec. 12).
