Activists claim that the Obama EPA's decision not to list a dioxin-contaminated Dow Chemical site on the Superfund National Priority List (NPL) will continue what they say is a weaker Bush EPA cleanup plan, but an agency source says the decision is based on other factors and not related to the cleanup's stringency.rnEPA Administrator Lisa Jackson in a May 26 letter to activists living near the site in Midland, MI, said EPA will not list it on the NPL. Instead, she said EPA Region V will continue negotiations with Dow on a Superfund administrative order on consent (AOC) to clean up contamination on the Tittabawassee River and in the Saginaw Bay. The Michigan Department of Environmental Quality (MDEQ) will oversee the cleanup of the site immediately surrounding the Midland plant under its Resource Conservation & Recovery Act (RCRA) authority.
