BACKING BUSH, EPA REJECTS COMPLIANCE SCHEDULES IN TITLE V PERMITS

Upholding the Bush administration's position, the Obama EPA has rejected a long-standing call from environmentalists to include compliance schedules in Title V clean air operating permits if the facility has been issued an enforcement notice of violation (NOV), a move activists have sought to make the permits enforceable.rnEPA took the position in an April 20 response to a petition by WildEarth Guardians asking that Region VIII object to the Title V permit issued by Colorado for a coal-fired CEMEX cement plant in Lyons, CO, but the agency is also poised to respond in several court cases challenging Title V permits for other facilities.
