A key appeals court has rejected EPA's request to rehear its recent decision that lifted an informal agency prohibition on permitting a controversial wastewater-treatment method to blend partially and fully treated wastewater, leaving the Supreme Court as the agency's last option to overturn the ruling. The U.S. Court of Appeals for the 8th Circuit issued a July 10 order rejecting the agency's request for the full court to rehear en bane a three-judge panel's ruling in Iowa League of Cities v. EPA. "The petition for rehearing en banc filed by Respondent Environmental Protection Agency is denied. The EPA's petition for rehearing by the panel is also denied," the order says.
