Publicly owned treatment works (POTWs), crop and food processing groups are considering forming a coalition to push EPA to make permanent its three-year exemption for short-term emitters of biogenic greenhouse gases (GHGs) from Clean Air Act permitting. But the effort could depend on how a federal appellate court rules in environmentalists' pending lawsuit, Center for Biological Diversity, et al. v. EPA, contesting the agency's authority to grant the temporary exemption. Oral arguments were made in the U.S. Court of Appeals for the District of Columbia Circuit April 8.
