Virginia is urging the Supreme Court to overturn EPA's greenhouse gas (GHG) regulatory program by arguing that the agency relied too heavily on what it says is flawed United Nations (UN) data rather than its own science, making the state at least the third recent petitioner to ask the high court to scrap the agency's climate policies. Virginia Attorney General Ken Cuccinelli (R) in a March 20 petition for a writ of certiorari asks the high court to overturn a decision by the U.S. Court of Appeals for the District of Columbia Circuit that upheld EPA's finding that passenger vehicle GHGs endanger public health and welfare; a first-time fuel economy and GHG rule for cars that stemmed from the endangerment finding; and the agency's initial GHG permitting program.
