EPA Finalizes Revisions To Definitions In 'Tier 3' Fuels & Vehicle Air Rule

EPA has issued a final rule making a series of definitional changes to its "Tier 3" fuels and vehicle emissions rule and parts of its related renewable fuel standard (RFS) program, in response to criticism raised by some fuels industry groups over provisions that they said were confusing or would unfairly expand regulatory obligations. The rule amendments, published in the April 22 Federal Register, scrap some provisions that EPA already agreed to eliminate by withdrawing a direct final rule making some fixes to the Tier 3 regulation. The agency withdrew that direct final rule after receiving adverse comment, and instead pursued notice-and-comment on the new final rule.
