In December 1999 Mrs McMartin walked across a mown grass surface adjacent to the Girl Guide Hall in Taree, fell over and tore a tendon in her ankle. She suffered pain and incapacity, required surgery, developed a secondary shoulder condition from the necessity to use crutches, incurred substantial medical expenses and loss of income.
