Chapter 558 Process Is a 'Suit' Under Commercial General Liability Policies

In Altaian Contractors Inc. v. Crum & Forster Specialty Insurance Co.,the Florida Supreme Court held that the pre-suit "construction defect notice and opportunity to cure" process under Chapter 558 of the Florida Statutes is a "suit" as defined by standard commercial general liability insurance policies. Thus, this could require insurers to provide their insureds a defense through that process and prior to the commencement of arbitration or litigation.
