Key Court Cases: Recent Supreme Court Cases Favor Unions and Employees

Of the two unanimous cases already decided, one was union-friendly and the other employee-friendly. If the Court chooses to follow the lead of the Fair Pay Act in deciding Hulteen, and in a way that somehow ends with another unanimous opinion, what was once a divided Court is now starting to coalesce, though not in a way that many employers had probably hoped it would. But, as long as the Court keeps these unanimous holdings narrow and limited in scope, Supreme Court rulings will probably not disturb the current state of the law too drastically. The same cannot be said about the potential effects of congressional legislation. With the Fair Pay Act in the books and the Employee Free Choice Act on deck, there are big changes in store for labor and employment law.
