Court Requires Copyright Holder to Send DMCA Notices to ISP for Each Posted Infringement

In Wolk v. Kodak Imaging Network [No. 10 Civ 4135 (S.D.N.Y. 03/17/2011)], plaintiff Sheila Wolk moved for a preliminary injunction preventing Photobucket.com, Inc., from infringing her copyrights. Plaintiff is a visual artist. Photobucket is an Internet service provider (ISP) that hosts user-generated photos for storage and sharing. Users uploaded upwards of 8 billion photos to Photo-bucket. Plaintiff claimed that copies of her copyrighted images were uploaded to Photobucket without her permission.
