California Attorney General Sues Delta Airlines for Failure to Comply with State Mobile App Privacy Law

In People v. Delta Air Lines, Inc. [Cal. Super. Ct., 12-526741, complaint filed Dec. 6,2012], California Attorney General Kamala D. Harris filed suit in Superior Court in San Francisco against Atlanta, GA-based Delta Airlines for its failure to comply with the California Online Privacy Protection Act (CalOPPA), which requires that commercial operators of Web sites and online services, including mobile and social apps, conspicuously post a privacy policy so that consumers may be informed regarding what personally identifiable information (PII) is being collected and how it will be treated (i.e., if and how it will be shared with or sold to third parties). For mobile apps, the privacy policy must be posted within the app and not merely on the company's Web site.
