FCC Chm. Kevin Martin's use of data that deviates significantly from previous FCC studies failed to gain the support of other commissioners during an 11/27 meeting, resulting in its exclusion from the annual competition report. In the days leading up to the meeting, Martin came under fire after using data widely considered unreliable to invoke powers under a 1984 federal law that says if 70% of American homes can get cableTV with 36 channels or more and 70% also subscribe, the FCC can take regulatory action.
