Notwithstanding that both of these provisions are subject to avoidance by the agreement of the parties as might be expressed, inter alia, in the arbitration agreement, these opting out provisions are rarely if ever adopted in Australia. The State and Territorial law governing domestic arbitration in Australia, subject to agreement otherwise made between parties to an arbitration, provides that an award is final and binding and allows an arbitrator to make an interim award.
