The United States filed a complaint for condemnation on September 1,2009 for the taking of property under the power of eminent domain. The property at issue is 275.81 acres of land owned by Svonavec, Inc. The property includes approximately six acres of land on which United Airlines Flight 93 crashed on September 11, 2001. The federal government acquired a fee simple interest in the property, including oil and gas rights and eight acres of coal. The issue in this case is the amount of compensation owed Svonavec. The parties agreed that a commission should determine just compensation, and a commission composed of two real estate appraisers and one real estate attorney was appointed.
