Last month, the author reviewed the state of the law on enforcing mediation clauses. This month, she applies the lessons, and offers a sample clause. Someday there may be a federal statute or an amendment to the Uniform Mediation Act creating mediation clause enforcement by summary procedure analogous to that in the Federal Arbitration Act. But until then enforcement is likely to continue growing, though sporadically, subject to various state law and theories.
