Proposed Changes to MACT General Provisions Intended to Encourage Pollution Prevention

On May 15, 2003 (68 FR 26249-26265), EPA proposed changes to Part 63, Subpart A general provisions that would provide facilities regulated under EPA's maximum achievable control technology (MACT) standards with incentives to reduce emissions through source reduction measures. Under the proposed changes, facilities that use source reduction measures to completely eliminate hazardous air pollutant (HAP) emissions from their operations regulated by a Part 63 MACT standard would be eligible to qualify for exemption from the otherwise applicable standard. Under a second option included in the May 15, 2003 proposed rule, facilities could request alternative monitoring, recordkeeping, and reporting requirements if they have used source reduction to reduce emissions to at least the levels required by the applicable MACT standard. The May 25, 2003 action would also provide accelerated review times for members of EPA's National Environmental Performance Track program.
