Federal Plan Implements Emission Guidelines for Commercial/Industrial Solid Waste Incinerators

Under EPA's emission guidelines for existing commercial and industrial solid waste incineration (CISWI) units, states are required to submit plans to implement and enforce the emission guidelines within one year. If a state does not submit an approvable plan within two years, EPA is required to develop and implement a federal plan. On October 3, 2003 (68 FR 57518-57553), EPA issued a federal plan to implement the emission guidelines as a new Subpart III to 40 CFR Part 62. The federal plan applies to existing CISWI units located in areas of the country not covered by a state or tribal plan implementing the federal emission guidelines. Existing units are those for which construction commenced on or before November 30, 1999. Units for which construction commenced after November 30, 1999 are covered by the new source performance standards (NSPS) in Part 60, Subpart CCCC. EPA indicates that, at most, 116 units will be regulated under the federal plan over the first three years. The actual number of units affected will be lower than this estimate because many of the units are already, or soon will be, covered under state plans, rather than the federal plan.
