EPA Reconsiders MACT for Brick and Structural Clay Products Manufacturing

In an April 22, 2005 notice (70 FR 21094-21101), EPA announced that it has granted reconsideration of the agency's determination of what represents maximum achievable control technology (MACT) for brick and structural clay products manufacturing. The agency's decision to reconsider the 40 CFR Part 63, Subpart JJJJJ MACT is in response to a petition for reconsideration filed by the Sierra Club, which argues that EPA improperly set emission limits based on the use of dry limestone absorbers. As indicated in the April 22, 2005 notice, the agency has solicited comments on the types of control technologies used for tunnel kilns and the technical difficulties associated with such control technologies. In the April 22, 2005 notice, EPA indicates that the agency believes it correctly identified MACT in the final standards for brick and structural clay products manufacturing. Nevertheless, the agency has decided to reopen its MACT determination for additional comment—a decision that could significantly affect the emission limits in the final MACT standards.
