Phaseout Schedule Issued for Producing ODS to Export to Developing Countries

On December 29, 2005 (70 FR 77042-77048), EPA finalized a phaseout schedule for the production of ozone-depleting substances (ODS) manufactured for use in developing countries. Under the Montreal Protocol on Substances That Deplete the Ozone Layer, industrialized countries, such as the United States, are allowed to continue to produce ODS to meet the basic domestic needs of developing countries (so-called Article 5 countries). The December 29, 2005 final rule revises the manner in which a company's baseline for Article 5 production allowances is calculated, and establishes a step-down schedule under which permitted production for export is reduced until such production is ceased entirely.
