Prevention of Significant Deterioration PM-10 Surrogate Policy Repealed

On May 18, 2011 (76 FR 28646-28661), EPA repealed a provision in the federal prevention of significant deterioration (PSD) regulations allowing permit applications to be reviewed for PM-10 (particulate matter with an aerodynamic diameter of 10 microns or less), in lieu of meeting PSD analysis requirements for PM-2.5 (particulate matter with an aerodynamic diameter of 2.5 microns or less). The repealed provision (known as the PM-10 surrogate policy) was contained in 40 CFR §52.21(i)(l)(xi), and applied to PSD applications that were determined to be complete before July 15, 2008. As of the effective date of the final rule, any PSD permit applications covered by the provision in §52.21(i)(l)(xi) that have not yet been approved and issued a final and effective PSD permit will need to be re-evaluated to demonstrate compliance with the PM-2.5 PSD requirements. These requirements include showing that the proposed source will not cause or contribute to a violation of the national ambient air quality standards (NAAQS) for PM-2.5, and establishing emission limitations representing best available control technology (BACT) for PM-2.5.
