For the buy-to-let sector, there are other issues to keep an eye out for alongside HMRC's targeted campaign. Buy-to-let mortgages are currently exempt from Financial Conduct Authority (FCA) regulations as the government does not believe that buy-to-let owners need as much protection as standard owner occupiers. The upcoming European Mortgage Credit Directive will allow the government to continue this exemption, but it must put in place an alternative framework to protect consumers involved in buy-to-let borrowing. The government's consultation states that a 'consumer' could have inherited the property or previously lived there but is unable to sell it so resorts to a buy-to-let arrangement. As part of the changes, they now fall under the remit of the FCA.
