SALARY REMUNERATION AND EBT AVOIDANCE SCHEMES SHUT DOWN

As previously warned at the 2015 Autumn Statement, Chancellor George Osborne is shutting down disguised remuneration schemes, the most common of which are employee benefit trusts (EBTs), which avoid payment of national insurance contributions (NICs), raising £2.5bn for Treasury coffers through tightening the rules. There will also be a new charge on loans paid through such schemes which have not been taxed and are still outstanding on 5 April 2019. The measure prevents employer attempts to exploit the disguised remuneration legislation by inserting an additional targeted anti-avoidance rule (TAAR) with effect from 16 March 2016 while the withdrawal of the relief on investment returns will have effect after 30 November 2016.
