LIABILITY FOR EMPLOYEES THAT DO NOT TRANSFER

Under the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) a new service provider or transferee will be liable in respect of any claims that transferring employees might have had against the transferor. That liability also extends to those employees that would have transferred if they had not been dismissed by reason of the transfer.
