专利海盗的危害与应对措施

摘要

The occurrence of patent troll disturbs the orders in market and hinders the development of enterprises. As it has not caused serious harm in our country, we have not any institutions to restrict it.However, we should refer to ex-periences of foreign countries, especially in legislative work, judicial work and administrative work, and take an advanced step in enforcing it.Moreover, government departments should share their owe information.The establishment of intellectu-al property court and the modification of the law for promoting the transfer of technology have made a solid foundation for coping with the patent troll.%专利海盗的出现扰乱了市场秩序，阻碍了企业的正常发展。由于它在我国还未造成严重危害，我国还没有专门限制它的制度和法律。我国应当参考国外，特别是美国、韩国的经验，从立法、行政、司法多方面选择应对措施先行先试，并加强之间的信息传递与总结。立法、行政方面，促进科技成果的转化与流转、提高授予专利的质量、转让专利时加强审核等；司法方面，限制专利海盗的起诉、加强适用技术分摊规则、慎用停止侵权等。我国知识产权法院的成立，《中华人民共和国促进科技成果转化法》的修改，为我国应对专利海盗提供了强有力的支持。
