全球的社会宪法

摘要

The political Constitution of nation state is a special Constitution, which could hardly car-ry out the constructive and restrictive function to other social field outside politics or balance self-reign and expansion of different social systems. Globally, due to the inactiveness of political Constitu-tion, the off center tendency and inter-infringement of different global social systems become more se-rious, which leads to new Constitutional issue. All this leads to the emergence of global social Consti-tution, which aims to support and conquer different social power and shows a“fragmentary”pattern due to different social systems. Different segments of global social Constitution must conflict against each other and this should be solved with a kind of“new conflict law”.%民族国家的政治宪法只是一种特殊的宪法，难以面向政治以外的其他社会领域执行构成性和限制性的双重功能，平衡诸社会系统的自治与扩张。在全球层面上，由于政治宪法始终无法运转，各种全球社会体制的离心倾向和相互侵犯更加严重，已经造成了新的宪法问题。全球社会宪法应运而生，旨在支撑和驯服不同的全球社会力量，因此呈现随体制而异的“片段化”形态。全球社会宪法片段之间必然发生的碰撞，应当依靠一种“新冲突法”加以解决。
