精神赡养的若干现实与理论问题--探视父母义务之立法化研究

摘要

With the aging problem coming into view, this paper discusses about the“Law on the Protection of the Rights and Interests of the Aged”and its Article 10 to 11, especially about the content of“spiritual consolation”. Many proposals are put forward, for example, whether this may be put into law, why into law, whether applicable, and how to legalize this. The paper attempts to answer these questions and analyze the justiifcation and possibility of the legal obligation of visiting the elderly parents and providing spiritual consolation.%随着中国人口老龄化问题日趋严重，《老年人权益保障法》及其中的“精神慰藉”规定便成了人们关注的焦点之一。人们陆续提出“常回家看看”是否可以列入法律进行规制，入法规制的正当性理据何在，是否具备可行性，如何实现等问题。文章试图从实证调研、传统文化与制度建构等多重角度，来回答上述疑问，探讨探视父母义务之立法化的正当性与可能性，最终形成一个综合的制度性构想，促进老龄事业发展。
