民生与社会保障法的法理分析

摘要

People's livelihood and social security are closed relat-ed twin brothers. Starting from the relationship between the two, this paper deeply analyzes the core contents, role and main structures of social security law, so as to provide beneficial expe-rience for the construction of China's social security legal system. This paper discussed this issue from three aspects.%　　民生问题与社会保障是一对紧密联系的孪生兄弟，离开社会保障，民生如同无源之水；离开民生，社会保障如同无本之木。本文试图从两者关系入手，深入分析社会保障法的实质内容、作用以及主体结构，从而为构建我国社会保障法律体系探索有益的经验。全文由三大部分组成：一、社会保障理论与法律制度的演进；二、民生与社会保障法的关系；三、社会保障法的法理分析。
