我国铁道建筑行业建立标准必要专利机制的必要性和可行性研究

摘要

This paper analyzed the relationship with opposite and unity between technical standard and patent by the defini-tion and connotation of patents,technical standard,standard essential patents.And through the analysis of the characteris-tics of the railway construction industry patent and technical standard,it also studied the necessity and feasibility about es-tablishing standards essential patents mechanism in railway.%本文从专利、标准、标准必要专利的定义和内涵入手，分析专利和标准的对立和统一关系，进而通过分析铁道建筑行业专利和技术标准的特点，研究在我国铁道建筑行业建立标准必要专利机制的必要性和可行性。
