控规调整参与主体博弈过程与约束机制检讨

摘要

The paper lists five stakeholders in the gaming of regulatory planning adjustment:demand subject,technological demonstration subject,assistant subject(relevant departments and experts),planning management subject,and the public.Then,the paper summarizes their characters,analyzes the game process in subjects view.This analysis reveals the defects of the mechanism:loose management of project application,limitation of technological demonstration,unbalance of rights and liabilities,baseless administrative discretion,and the short of expression of public interest.%文章将参与控规调整博弈过程的主体分为五大类:需求主体、技术论证主体、论证辅助主体(相关部门和专家)、规划管理主体及社会公众,进而对这五类主体的特征进行归纳,并分别从各类主体的视角对控规调整的博弈过程进行分析.分析表明,各参与主体博弈过程中的问题,源于当前控规调整的约束机制存在缺陷——项目申请管理宽松、技术论证存在局限、参与主体权责失衡、行政裁量缺乏依据、公众利益表达缺位.
