试论合理使用制度博弈学术型数据库被垄断现象--以我国高校图书馆为例

以程焕文教授的博文《十问数字出版商！！！》为导火索，在数字出版商滥用市场优势和限制竞争造成学术型数据库被垄断的背景下，论文总结了数字出版商垄断现状及手段，并结合著作权法中的合理使用制度，针对高校图书馆就完善法律法规和加强图书馆自身优势两个方面提出建议。%Under the background of Ten Questions about Data Providers written by Professor Chen Huanwen was published and the violent monopoly of the academic databases, this paper displays the status and means of data providers’monopoly. By combining the fair use system in copyright law, it discusses proposals for university libraries in China from two aspects, including improving laws and regulations and enhancing library’s advantages.
