我国民办高校的法人属性界定

摘要

From the perspective of realizing the function and the purpose of education, there is an intrinsic consistency between civilian-run colleges/universities and public universities. The civilian-run colleges and universities are defined as“non-governmental nonprofit units” nowadays. However, this definition is lack of fundamental legal basis. Researching and illustrating the legal person attribute of the civilian-run colleges and universities and then defining them as“institution legal person” are significant. It is helpful to realize the legal status of civilian-run colleges and universities, and promote the process of the educational modernization and educational legalization in China.%从实现教育的功能和目的来看，民办高校同公办高校在本质上具有内在一致性。将民办高校的法人属性界定为“民办非企业单位”的做法缺乏基本法上的依据。研究并明晰民办高校的法人属性，将民办高校界定为“民办事业单位法人”，对实现民办高校的法律地位、推进我国教育现代化和法治化进程具有重要意义。
