医学教育临床实践中医疗责任分配制度完善探析

摘要

The distribution of the clinical responsibilities in the clinical practice of the medical education is the key to the order and the clinic personnel training.In combination with the evaluation and analysis of Interim Provisions on the Management of the Clinical Practice of the Medical Education, mainly discusses the existing problem in the distribution of the clinical responsibilities in the clinical practice of the medical education. From the view of the guiding ideology,value orientation to the subject, constitutive requirements, the system of the relief for the risk liability make some suggestions.%医学教育临床实践中的医疗责任分配是秩序保障、医学人才培养的关键点,在临床实践中潜在风险不断加大、医患之间互信降低背景下具有重要的现实意义,通过对《医学教育临床实践管理暂行规定》第十六条、第十七条分析,认为当前我国责任分配缺乏公平正义,责任主体存在缺位,责任构成要件与上位法不一致,进而提出完善建议:调整立法指导思想与价值取向,实现“秩序”与“正义”的统一；调整责任构成要件,保持与上位法的协调,实现责任分配的公平与正义；建立责任赔偿基金,保障临床实践秩序.
