论我国精神卫生立法之衡平正义

With more and more "be mental illness", the essence of the legislation of mental health has become the focus in public, in order to protect the mental patients. Taking the balance of justice as the point, the legal process of mental health, its essence and the tendency of the legislation of mental health was discussed in the thesis, so as to give references for the development of the legislation of mental health.%在“被精神病”事件层出不穷的今天,为了保障精神病患者的正当利益,精神卫生立法的核心价值诉求成为人们探讨的焦点和难点.以衡平正义为切入点,分析了我国精神卫生立法的进程,且重点讨论了其核心价值诉求的演变以及发展趋势,以对我国精神卫生立法向衡平正义的方向发展提供一定的理论参考.
