论监理单位在工程建设中的地位

摘要

监理单位在建设监理中的地位问题是监理理论的基础。对FIDIC(国际咨询工程师联合会)建设模式及其合同结构进行研究，分析了工程建设中的两对委托-代理关系，从而论证了市场经济中监理单位的角色和地位。监理单位是受业主委托管理工程建设的一方，它向业主提供“工程管理”服务，从业主那里收取监理费。监理单位应该站在业主的立场上为业主服务，不应该过分强调监理单位在责任意义上对业主的独立性。监理单位的准仲裁员身份可以由真正独立的第三方（如DRB）来承担。%In this paper, the contract structure is studied to find out thefunction of theengineer by using the Principal——Agent theory．The conclusion is that the engineer should be on behalf of the client while the engineer gets payment from the client and that the independence on the client of the Engineer should not be over emphasized.
