司法实践中保证责任相关问题研究——以民事立法为视角

With the rapid economic development, higher vocational college has to deal with challenges from local industry structure and seize the development opportunities from local economic growth mode.Higher vocational colleges also play advantages of high skilled talents and develop a group of innovative enterprise-pioneering talents to serve local industry innovation and upgrading.%民商事交往活动中,保证责任是一核心问题.我国以债权人利益为侧重点的保证制度立法,对当下民商事纠纷多方当事人的利益保障尚存不少争议,就司法实践中,未约定保证方式的保证责任定性、一般保证人责任承担等相关问题,提出相关的见解,以期为民事立法建言献策.
