案例指导制度功能定位反思--兼论大陆法系判例与英美法系判例之差异

After the Supreme Court made a special proclamation on judicial Guiding cases, the discussion about judicial guid-ing cases system has become a focal point against such background.This paper explores the force of judicial guiding cases, and then it distinguishes precedents of Anglo-American law family and its counterpart of civil law family.Finally, it explains which approach we should choose, considering what function the guiding cases make, unifying the application of law, fulfilling the legal loopholes or setting an example in argumentation in order to reflect the location of the functions of judicial guiding cases.%最高人民法院案例指导制度出台后，围绕该制度的讨论随之升温，其中指导性案例的效力和功能是讨论的重点。从指导性案例的效力出发，探究当前指导性案例的效力，在分析大陆法系判例与英美法系判例差异的基础上，阐述我国案例指导制度的进路选择，探讨指导性案例在统一法律适用、漏洞填补和说理论证规范方面发挥的作用，对指导性案例的功能定位作出反思。
