论高校学生工作中的正当程序原则*--高校治理现代化的视角

摘要

The core idea of due process is “to restrict power by procedures” and “to protect right by procedures.” When administrating the college student affairs ,the principles of due process should be implemented and the transformation of governing structure should be enforced actively,so as to promote the modernization of governance system and gover-nance capacity. During the process of achieving the modernization of university gover-nance,the principles of due process plays the roles of value-orienting,system supporting and self-regulating.%正当程序的核心思想是“以程序制约权力”和“以程序保护权利”。高校学生工作应贯彻正当程序原则，自觉实现治理转向，促进治理体系和治理能力现代化。在实现高校治理现代化的过程中，正当程序原则发挥了价值导向、制度保障和自我规范作用。
