我国保险代位求偿权的法律保护

摘要

It is an important task in the perfection of the legal protection for the right of insurance subrogation system. In order to achieve this, the perfection of the system of insurance subrogation should be made to give double protection for the insured while avoiding the over benefit of them. The difficulties and problems are analyzed by starting from the basic theories of insurance subrogation and the legislation of the other countries in order to perfect the insurance subrogation right in our country from the perspectives of legislation, procedure and entity guarantee.%　　我国的立法和司法实践并未完全理解保险代位求偿权制度。如何完善我国的保险代位求偿制度，使之既能为被保险人的利益提供双重保障，又能防止被保险人因保险赔偿过分受益导致不当得利的现象，是今后完善我国保险代位求偿权法律保护的一项重要任务。要从保险代位求偿权的基本理论以及各国立法实践入手，分析我国的保险代位求偿权在实践中的困境与问题，以期从立法、程序、实体保障多方面完善我国的保险代位求偿权。
