劳动基准法中的惩罚性赔偿制度

     

摘要

惩罚性赔偿制度起源于英美法系,该制度一直是一项备受关注的制度,其不仅对英美法系国家产生了影响,甚至对大陆法系国家也产生了较大影响,同时,该制度也是我国民事立法与民法学研究较为热点的话题,它具有惩罚和遏制违法行为等民事法律制度不常有的功能。从我国目前的实际情况来看,在劳动争议纠纷案件日益增多的今天,侵害劳动者合法权益的行为层出不穷,劳动争议案件与一般的民事案件相比具有一定的特殊性,仅单纯地适用补偿性赔偿制度不足以遏制用人单位违反劳动基准法从而侵害劳动者合法权益的行为。因此,可以在劳动基准法领域中规定惩罚性赔偿制度,以达到减少用人单位违反劳动基准法行为的目的。%Punitive compensation system was originated in Anglo-American Legal System countries,attracting continuous attention.This system affects not only the Anglo-American Legal System countries,but also the Common Law countries. Meanwhile,it is also a hot topic in the field of civil legislation and civil law system in China. It has multiple functions,which civil law system hardly has,including punishment and prevention. In current situation,with the increasing number of labor dispute cases there are increasing cases of violating laborer’s common rights,which are unique and different from normal civil cases.The application of compensatory compensation system is not enough to restrain employer from violating the labor standards and from violating laborer’s rights and interests. The author puts forward the proposal that it is necessary to apply punitive damages system to standards law in order to reduce violations.
