所有权、契约和不法--黑格尔抽象法基本概念解读

摘要

In the famous work Elements of the Philosophy of Right, Hegel discussed the conception of right and the realization of the conception.Abstract right is the first phase of the right.Hegel stated three parts,prop-erty,contract and wrong,when he was explaining the abstract right.Thus three concepts can be considered as the summaries of the relationship between people and things,people and people,particular will and general will. Then,the freedom got the abstract form and finally turned itself into reality.%黑格尔的《法哲学原理》系统讨论了法的理念及其现实化的内容。而抽象法是法直接性的初步显现的阶段，在对抽象法的论述中，黑格尔分别阐述了所有权、契约以及不法三个环节的内容，这三个概念可以看作是黑格尔对人与物的关系、人与人关系及特殊意志与法本身关系的综述。自由由此而获得抽象性，进而凭借自由的抽象性，意志不断的实现自我否定，并获得规定性及定在的形式。黑格尔通过抽象法、道德以及伦理这三个定在形式逐渐实现真正的自由。
