试论规范行使人大代表言论免责权

摘要

In the process of formation and development of the rule of law supervision system, standard exercise disclaimer right of speech of representatives of the People ’s Congress is the key that play the National People’s Congress and its standing committee supervision power. But China’s disclaimer right of speech of representatives of the People’s Congress appears too narrow power scope, unknown legal effect, unclear power and responsibility. It expand the scope and way of disclaimer right of speech of representatives of the people ’s congress, clear the legal effect of power exercise, standard exercise disclaimer right of speech of representatives of the People’s Congress play real effect that representatives of the People’s Congress exercise state power in the process of promoting the rule of law in China construction.%在法治监督体系形成与发展的过程中，人大代表言论免责权的规范行使是发挥人大及其常委会监督权能的关键。但是，我国人大代表言论免责权却出现权力范围过窄、法律效果不明、权责不清等问题。扩展人大代表言论免责权行使的范围与途径，明确权力行使的法律效力，规范行使人大代表言论免责权，才能在推进法治中国建设进程中发挥人大代表们代表人民行使国家权力的真正效力。
