粤北民间文学艺术的现状及其法律保护研究--以韶关地区为例

摘要

粤北民间文学艺术在全球化、信息化、现代化的冲击下，面临日渐式微与流失的困境。而当前民间文学艺术的保护主要是行政主导的模式，文化主体反而处于边缘状态。应在知识产权框架内贯彻法律的衡平原则并推进民间文学艺术专有权制度的构建，实现民间文学艺术的活态传承与发展。%Under the impacts of globalization, informatization and modernization, the folk literature and art of Northern Guangdong Province are in the predicament of gradually declining and losing. The current protections are administrative-oriented, and instead, the main cultural entities have been marginalized. To inherit and develop the folk literature and art, we should implement the principle of balance in the framework of intellectual property law, and promote the construction of the exclusive rights system.
