新行政诉讼法一般起诉期限变化问题研究——以房管行政为主要分析对象

The Standing Committee of the National People's Congress has passed the amendment on the Administrative Procedure Law, in which the General Statute of Limitation has been modified from 3 months to 6 months.This modifi-cation not only lengthens the administrative procedure period, but also places more pressure on administrative depart-ments, and has a significant impact on the exercise of public power.Besides, it also makes higher demands on ad-ministrative departments to administration according to law, protect the rights of citizens and solve disputes voluntari-ly.%全国人大常委会 《关于修改<中华人民共和国行政诉讼法>的决定》 对行政诉讼的一般起诉期限作出重大修改, 将诉讼期限由原来的三个月延长至六个月. 此番修改延长了诉讼周期, 增加了行政机关应诉压力, 对行政机关的行为效力、 权力行使产生了重大影响, 也对行政机关在依法行政,保障相对人合法权益, 积极解决行政纠纷等方面提出了更高的要求.
