论综艺节目模板的作品属性及其法律保护

摘要

节目模板是否属于表达,是其能否获得著作权保护的核心争论点.现行主流观点认为节目模板属于思想,难以构成著作权法意义上的表达.为了正确认识节目模板的作品属性,本文将综艺节目模板的概念从广义和狭义两方面进行认识.从狭义层次去理解,节目模板是由文字形式表现的节目制作宝典,可以将其认定为文字作品.但其内容不构成表达,对其内容中方法、规则的抄袭,不构成著作权法意义上的侵权.为了更好地保护权利人的利益,反不正当竞争法可以成为节目模板的主要法律保护方式.%The idea/expression dichotomy is at the heart of the debate on whether television formats are copyrightable.The current mainstream view is that the television format is idea,and it is difficult to constitute copyright works in the sense of the law.In order to correctly understand the properties of the television format,this article will analysis television format concept from both broad and narrow sense of awareness.Considered from a narrow level,the television format is the performance of the text form of Format Bible which can be identified as text works.But its content does not constitute an expression.It does not constitute copyright infringement for the content of its method and rules of the format.In order to better protect the interests of right holders,anti-unfair competition law can be the main legal protection mode of the television format.
