食品安全法中惩罚性赔偿制度研究

摘要

本文从惩罚性赔偿制度的基本原理入手，介绍了惩罚性赔偿制度的沿革，及在两大法系的现状。细述了食品安全的现实状况及严重影响，建立惩罚性赔偿制度的必要性和作用。分析了我国食品安全法中的惩罚性赔偿制度在责任主体、赔偿标准、赔偿数额存在的问题；并从明确主体、建立食品追溯制度、完善统一标准与举证责任、赔偿基数合理认定等方面提出完善建议。%　　In food security domain,washes the shrimp meal from three deer pow dered milk to the Jinhua phosphate insecticide ham to Nanjing and so on some serious influence general populace food security,ex-plained that the punitive compensation system has not played the proper role in food security domain Im-proving the punitive compensation system to be imminent This article obtains the punitive compensation system’s basic principle,introduces the punitive compensation system’s evolution,and in tw o big legal sys-tem present situations This paper is clear about the main body,the establishment food back ward system, to consummate the unified standards,the compensation cardinal number recognized reasonably and so on aspects proposed consummates the suggestion
