民族自治地区刑事精神损害赔偿立法路径探索——从少数民族刑事习惯法中的“人命钱”“眼泪钱”和“洗礼钱”导入

China＇ s current criminal legislation many minority areas, the compensation for moral excludes compensation for moral damage, while in damage ＂money for tear＂ and ＂money for eliminating the stigma＂ objectively exist, such as ＂oney for life＂, There are many drawbacks for the lack of criminal mental compensation, especially in autonomous minority nationality areas. Therefore, the legislation should be combined with the criminal custom law, and the autonomous minority nationality areas can explore the legislation route about criminal mental compensation.%我国现行立法排斥刑事精神损害赔偿，而在许多民族地区，民间的刑事精神损害赔偿却客观地存在，例如一些少数民族刑事习惯法中的“人命钱”“眼泪钱”和“洗礼钱”等。我国刑事精神损害赔偿的缺失本身就有许多弊端，而在民族地区，由于与一些民族习惯法相悖，这些弊端更显突出。因此，应结合少数民族刑事习惯法，探索民族自治地区刑事精神损害赔偿的立法路径。
