多数同意与保护少数:论民主政治中的多数原则

摘要

With the development of Western-style democracy, the principle of majority has become one of the fundamental principles of Western democracy.There are also discussions about majority principle from Aristotle to Startori who are the political thinkers standing for their own period, which has formed a clear development process.What's more, from the view of legitimate source, we can find the combination of the principle of majority and democracy is inevitable.The core of the principle dispute is how to balance the two parts of majority and the rights of minorities which seems paradox.In this regard, in order to build a realistic solution, the Western democracy solves the problem from three aspects which are Constitution, rights protection, political and cultural levels.%随着西方民主的发展,多数原则已经成为当今西方民主政治的基本原则之一.自亚里士多德到萨托利,不同时期的政治思想家们对多数原则均有论述,形成了清晰的理论发展脉络;而从合法性来源探讨,可以发现多数原则与民主政治的结合具有必然性.该原则争议的核心是如何对多数人同意和保护少数人的权利看似悖论的两者兼顾和协调,对此,西方民主政治分别从宪政制度、权利保障、政治文化三个层面入手,提供了现实的解决方案.
