雇佣自由与限制解雇之协调——现代劳动制度构建的应然选择

     

摘要

雇佣自由是市场经济条件下自由企业制度的内在体现,限制解雇则是实质平等目标下为维护弱者利益而做出的合理安排。作为从不同理论基点出发的制度体系,二者具有各自独特的价值功能,不能过分强调其中的一个方面而忽视另一方面。正确处理两者之间的关系,应努力做好雇佣自由与限制解雇之间的协调,从而把保护劳动者利益和促进企业的可持续发展有机统一起来。%Free employment is the inherent property of free enterprise system under the market economy,and restricted dismissal is the reasonable arrangements for safeguarding the interests of the weak under the goal of substantive equality.As the two systems have different theoretical bases,either has its unique value function,and it is not right to favor one and neglect the other.The right way to handle the relationship between the two lies in the coordination of the relationship between free employment and restricted dismissal and the relationship between the protection of the interests of workers and the sustainable development of enterprises.
